CHAMPVA Denied Because DEERS Shows TRICARE: How to Fix It

If CHAMPVA was denied because DEERS shows TRICARE eligibility, here's why it happens, how to check DEERS, and how to get VA to look again.

    The short answer

CHAMPVA checks DEERS, the Defense Department's enrollment record. If DEERS shows you're eligible for TRICARE, CHAMPVA has to deny. First find out whether DEERS is right. If it's wrong, get it corrected through milConnect or an ID card office, then send proof to CHAMPVA and ask them to review the denial again.

Why does a TRICARE flag block CHAMPVA?

Because the law says so. Under 38 U.S.C. 1781 and 38 CFR 17.271, someone eligible for TRICARE can't get CHAMPVA. VA's CHAMPVA page says the same thing.

CHAMPVA learns about TRICARE eligibility from DEERS, the Defense Enrollment Eligibility Reporting System. So if DEERS says you're TRICARE-eligible, CHAMPVA will usually deny, even if you've never used TRICARE.

Is the DEERS record actually wrong?

Sometimes it's right, and that's important to know before you spend weeks fighting it. Common situations:

    SituationWhat usually happens
Sponsor is a military retiree (20+ years, or medical retirement)Family is usually TRICARE-eligible. CHAMPVA doesn't apply.
Sponsor is a Reserve retiree under 60 ("gray area")Depends on TRICARE Retired Reserve enrollment and DEERS status. More here: CHAMPVA and TRICARE Retired Reserve.
Divorced spouse who meets TRICARE's former-spouse rulesMay still be TRICARE-eligible as a former spouse.
Survivor of a service member who died on active dutyUsually TRICARE-eligible as a survivor. More here: CHAMPVA after a line-of-duty death.
Old sponsor or dependent data never updatedDEERS may show eligibility that ended long ago. This is the one that's usually fixable.

    How do you check DEERS?

    1. Log in to milConnect and look at the health care eligibility listed for you.
    2. Call the DMDC Support Center at 800-538-9552 if you can't log in or the record doesn't make sense.
    3. Visit an ID card office. You can find one with the ID Card Office locator. Bring the documents that prove what's changed, such as a divorce decree, a death certificate, or the sponsor's discharge or retirement papers.

Ask a specific question: "What TRICARE eligibility does DEERS show for me, and what's the start and end date?"

How do you get DEERS corrected?

DEERS changes are made by DMDC, ID card offices, or the sponsor's service branch, not by VA. Bring proof, ask them to correct the record, and ask for something showing the change, such as an updated milConnect screen or a letter.

If the sponsor has died or isn't involved, the ID card office can usually still update a dependent's record with the right documents.

How do you get CHAMPVA to look again?

    Once DEERS is corrected:

    1. Call CHAMPVA at 800-733-8387 and tell them DEERS has been updated.
    2. Send proof of the corrected DEERS status with a short, signed letter asking CHAMPVA to review the denial. Include your name, the Veteran's name, and the date of the denial letter.
    3. Follow the review options in your denial letter if CHAMPVA still says no. More here: CHAMPVA appeals.

Keep copies of everything and write down the date and name of each person you talk to.

    What if DEERS is right?

Then TRICARE is your coverage, and CHAMPVA isn't available while you're TRICARE-eligible. More here: TRICARE vs. CHAMPVA vs. VA health care and What to do if you don't qualify for CHAMPVA.
